Terms of Use
These terms govern your use of the Context Passport iPhone app, the Passport connector that AI tools call, and Passport chat (together, "Passport" or "the service"), provided by Cloudy Tuesdays LLC, a Florida limited liability company ("we", "us"). By using Passport you agree to these terms and to our Privacy Policy. If you don't agree, don't use Passport.
The app is licensed to you under Apple's Standard Licensed Application End User License Agreement (the "Apple EULA"), as supplemented by these terms. Where the two differ, these terms apply to the extent the Apple EULA allows.
1. Who can use Passport
You must be at least 13 years old (16 in the European Economic Area and the UK) and able to agree to these terms. If you're a minor where you live, a parent or guardian must agree on your behalf. Passport is for personal use; one account is for one person.
2. Your account
Syncing, connections and Passport chat need an account, created with Sign in with Apple. You're responsible for activity on your account and on the connections you approve. Approve connections only on consent pages you opened yourself, and enter pairing codes only there.
3. What Passport does, and doesn't
- Passport stores cards and returns them to tools you connect, within the namespace and categories you allow. Facts a connection submits in allowed categories are saved automatically, without a review step; you can edit, undo or delete them afterwards.
- Connected tools decide when to call Passport. We don't guarantee that a tool will recall or save any particular fact, that it will use what it receives, or that it supports Passport on every plan, app or device. Tool providers can change their products at any time.
- Passport doesn't read your conversations, doesn't change a tool's built-in memory, and can't recall information a tool already received.
- Automated checks (for secrets, sensitive information or instructions) reduce risk but can't catch everything. Don't store passwords, keys, ID numbers, payment details or other secrets in Passport.
- Cards are labeled with the connection that saved them. A label like "Stated, as reported by Claude" reflects what the tool reported, not something we verified.
4. Third-party AI tools
AI tools you connect are provided by other companies under their own terms and privacy policies. When you connect one, you authorize us to send it the cards its permissions allow. We aren't responsible for those tools, what they do with the information they receive, or their availability.
5. Passport chat and AI output
Passport chat replies are generated by Anthropic's Claude models running on Amazon Bedrock. AI output can be inaccurate, incomplete or out of date, and can misread your cards. Check anything important. Nothing in Passport is legal, medical, financial or other professional advice. Passport chat answers and remembers; it doesn't browse, send messages, buy things or act in other apps.
6. Free plan, Passport Pro and limits
Passport is free to start. Passport Pro raises the limits on connections, namespaces, synced cards, recalls, saved facts and Passport chat messages, and adds a choice of chat models. The current limits for each plan are shown in the app (Settings) before you buy.
To keep the service affordable and available, Passport chat may be temporarily unavailable when overall capacity is reached, even if you have messages left. We won't reduce a paid plan's published limits during a period you've already paid for.
Your data is never held hostage. On every plan, and after a subscription ends, you can read, export and delete your cards, change or remove connections, and delete your account. If your subscription ends and you're above the free limits, nothing is deleted; new saves from tools are skipped until you're within the free limits again.
7. Auto-renewing subscriptions
- Passport Pro is available as an auto-renewing subscription: $4.99 per month or $39.99 per year (US prices; the App Store shows the price in your currency before you confirm).
- New subscribers may be offered a one-week free trial. When the trial ends, the subscription starts and you're charged unless you cancel at least 24 hours before the trial ends. Eligibility for the trial is decided by Apple.
- Payment is charged to your Apple Account when you confirm the purchase (or when the free trial ends).
- Your subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
- Manage or cancel in your iPhone's Settings → [your name] → Subscriptions, or from Passport's Settings → Manage subscription. If you cancel, Pro stays active until the end of the paid period. Deleting the app or your Passport account does not cancel the subscription.
- Any unused portion of a free trial is forfeited when you purchase a subscription.
- Refunds are handled by Apple under its policies, at reportaproblem.apple.com.
- If the price changes, Apple will notify you and, where required, ask for your consent before renewing.
- A subscription unlocks Pro for the one Passport account that first registers it.
8. Your content
Your cards, messages and settings are yours. You give us permission to store, process, encrypt, decrypt and transmit them only as needed to run Passport for you: to show them to you, to return them to connections you approved, to send them to Passport chat's model when you chat, and to keep backups. We don't use your content to train AI models and don't sell it.
You're responsible for what you store and share through Passport, including information about other people. Only share what you have the right to share.
9. Acceptable use
You agree not to:
- Use Passport for anything illegal, or to store or distribute content that infringes others' rights or harms others.
- Access another person's account, namespace or connection, or probe, scan or test the service's security without our written permission.
- Circumvent plan limits, rate limits, App Attest, or subscription checks, or use automated means to create accounts or generate load.
- Use Passport to store instructions meant to manipulate AI tools, or to attack other systems.
- Copy, modify, reverse engineer, resell or redistribute the app or service, except as the law allows.
We may suspend or end access for accounts that break these terms or put the service or other users at risk. Where reasonable, we'll tell you first and give you a chance to export your data.
If you find a security issue, please report it to help@cloudytuesdays.com.
10. Availability and changes to the service
Passport runs on Amazon Web Services and depends on Apple and on the AI tools you connect. We don't promise it will be available without interruption. Phone-only cards and the last synced copy on your iPhone stay readable when the service is unavailable. We may change or discontinue features; if we shut down the hosted service, we'll give at least 30 days' notice in the app so you can export your data.
11. Ending your use
You can stop using Passport at any time and delete your account in the app (Settings → Delete Passport account). What happens is described in Delete your account and the Privacy Policy.
12. Disclaimer of warranties
Passport is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't warrant that any connected tool will work with Passport, or that automated checks will catch all sensitive or secret information.
13. Limitation of liability
To the extent the law allows, we won't be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, including anything a connected tool does with information it received. Our total liability for any claim relating to Passport is limited to the greater of the amount you paid us for Passport in the 12 months before the claim, or US$50. Some places don't allow these limits; there, they apply only as far as permitted.
14. Apple
These terms are between you and us, not Apple. Apple is not responsible for Passport or its content and has no obligation to provide maintenance or support for it. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. We, not Apple, are responsible for addressing claims relating to the app (including product liability, legal or regulatory compliance, consumer protection and intellectual property claims). You represent that you are not located in a country subject to a U.S. Government embargo, or designated as a "terrorist supporting" country, and are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
15. Governing law
These terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. Courts in Florida have jurisdiction over disputes, except that this doesn't take away any protection you have under the mandatory consumer laws of the country where you live, or your right to bring a claim there.
16. Changes to these terms
We may update these terms. We'll post the new version here with a new effective date and, for significant changes, tell you in the app before they take effect. If you keep using Passport afterwards, the new terms apply.
